Personal Online Banking Terms of Use

These terms of use are for individuals only.

Benchmark Bank is pleased to offer internet banking access to customer accounts by acceptance of this agreement. The purpose of the agreement is to identify, describe, and state the general terms and conditions that will apply to the internet based banking service offered by Benchmark Bank.

The terms you and your will identify and refer to each person who applies for and is approved for online banking access to any account or service offered by Benchmark Bank. Upon acceptance of this agreement, a valid and binding contract between you and Benchmark Bank exists.

You understand that Benchmark Bank will act upon instructions received with respect to any online banking service via your user ID and password without further inquiry into the identity of the person using the password. Except as otherwise provided by law with respect to unauthorized electronic fund transfers, you will be liable for all transactions authorized with the use of your user ID and password.

If you give your password to someone, you have failed to protect its secrecy. You do so at your own risk and liability. You are informed that anyone with your password will have access to all of your accounts. If you believe that your password has been compromised, contact the bank immediately or change your password online.
We cannot accept notification of lost or stolen user IDs or passwords via e-mail. You agree under no circumstances to disclose your user ID or password to anyone whom you have not authorized to access your accounts, including anyone claiming to represent Benchmark Bank. A Benchmark Bank employee will never ask for your password or send you an e-mail asking for your user ID and/or password.

Benchmark Bank will establish internet banking access for you using an assigned user ID and password. If the user ID you request is already in use, you will be asked to select a different user ID. You will be required to change your initial password at first login. The password will be case sensitive and must be 6 to 10 alpha and numeric characters in length. We recommend that you change your password frequently. All passwords will be prompted to be changed every 90 days. Passwords can be changed online at anytime. After three (3) failed attempts to enter your password, you will be locked out of Benchmark Bank Online. You will need to call Benchmark Bank to be unlocked.

User IDs and passwords must be kept active to continue use of Benchmark Bank Online. Logging into the service will keep your account active. User IDs and passwords will be dissolved after 180 days of inactivity. You will need to contact the bank to be reinstated. For joint account holders, each person will have a separate user ID and password. Each account holder on joint accounts will be responsible for all transactions that are made on that account by all other joint holders of the account.

By directing Benchmark Bank to transfer funds or make a payment of any kind through the use of any online banking service initiated with your user ID and password, you authorize Benchmark Bank to withdraw or transfer the funds necessary to complete the designated transaction. Requests for new accounts or changes of addresses cannot be handled through online services.

To the extent permitted by law, you agree to fully indemnify and release Benchmark Bank from any and all liability, and agree not to make any claim against Benchmark Bank or bring any action against Benchmark Bank, relating to its honoring and allowing any action or transactions that are conducted under your user ID and password.

Benchmark Bank Online’s business days are Monday through Friday, except for bank holidays. Benchmark Bank processes transactions on business days only. You may initiate a transaction through Benchmark Bank Online 24 hours a day, 7 days a week, except during maintenance periods. Any transactions initiated after business hours will be handled on the next business day. For a transaction to be posted on a current business day transactions must be conducted by 5:00 pm (EST). Any transaction conducted after this time will post on the next business day.

Benchmark Bank agrees to make a reasonable effort to complete all fund transfers as requested. Benchmark Bank will be responsible for acting only on those instructions actually received by Benchmark Bank and cannot assume responsibility for malfunctions in communications, facilities, or acts of others not under our control that may affect the accuracy or timeliness of transactions you conduct. Benchmark Bank will refund any fee that you may incur on your account as a result of an error that is Benchmark Bank’s responsibility.

Federal regulations require Benchmark Bank to limit certain types of transactions from money market and savings accounts. Under these regulations each account is limited to six (6) preauthorized electronic funds transfers including telephone transfers, Benchmark Bank Online transfers or bill payments, checks, and point-of-sale transactions. For money market accounts, of these six transactions, you are limited to no more than three transactions per month by check or point-of-sale. Each fund transfer or payment through Benchmark Bank Online from your money market or savings account is counted as one of the six limited transfers you are permitted each month. Payments to your loan accounts held at Benchmark Bank are not counted toward this limit.

Benchmark Bank will not be responsible for failure to provide access or for interruptions in access to Benchmark Bank Online due to a system failure or other unforeseen acts or circumstances.

Benchmark Bank will accept online stop payment requests from account holders on any check, except for official bank checks or other cash equivalent items. Benchmark Bank will process requests received prior to the posted cut-off time of 5:00 pm on the same business day received. Requests received after 5:00 pm will be processed on the next business day.The stop payment request must be received in enough time to give Benchmark Bank a reasonable opportunity to act on it prior to payment of the item. Generally, the stop payment requests are not processed until the cut-off time or later on that same business day.

Stop payment requests are not effective if, either before or within 24 hours of when the stop payment order was placed, the item has already been paid or cashed or the bank was otherwise legally obligated for its payment. A computer processes stop payment requests. Benchmark Bank assumes no responsibility if any information provided is incorrect or incomplete that would cause the check to be paid, for example an incorrect check number, account number, amount or date. The account holder is responsible for verifying if the check was already paid. Once placed, the stop payment order will remain in effect for 180 days from the date it was authorized. No notice will be provided to you that a stop payment is expiring. A fee will be charged for each stop payment. Expired stop payment requests may be renewed for a fee.

Benchmark Bank Online will allow you to view all deposit and loan account activity and information. You also will have the ability to transfer funds between accounts, order checks, request a stop payment and pay your Benchmark Bank loan with your Benchmark Bank checking account.

Benchmark Bank offers an online bill payment service. This service maintains a separate enrollment and approval process. Enrollment is online through Benchmark Bank Online. You must be enrolled in the online banking service in order to request the bill payment service.

Benchmark Bank Online and bill payment (a separate service agreement and enrollment from Benchmark Bank Online) are free services but Benchmark Bank reserves the right to charge for either of these services in the future. You will be notified in writing if a charge is ever assessed and given the ability to cancel service.

When using Benchmark Bank Online and bill payment, we may collect or store information through the use of cookies. A cookie is a small marker that is temporarily stored on your computer while you are transacting business on our internet banking site. This cookie will automatically remove itself when you log off of Benchmark Bank Online. Cookies are commonly used in web sites and will not harm your computer. This information collected or stored is for Benchmark Bank’s use only and will help navigate you through the site.

A person must be 18 years old to enroll for Benchmark Bank Online and bill payment. We do not knowingly collect information at our web site from children under the age of 18 years old.

Benchmark Bank, in its sole discretion, may refuse access to Benchmark Bank Online to any new or existing customer. You authorize Benchmark Bank to obtain and verify credit reports and other credit information from third parties to verify your suitability for Benchmark Bank Online.

Benchmark Bank has the right to terminate this agreement at any time. The agreement will automatically be terminated when you no longer have any accounts or a loan relationship with Benchmark Bank. You may also terminate this agreement at any time by notifying us in writing or by calling our bank office at 614-269-4400. Any such termination by you applies only to Benchmark Bank Online and not your Benchmark Bank checking account or other accounts.

Benchmark Bank is not responsible for the hardware or software required for the use of Benchmark Bank Online. You are responsible for providing your own internet service provider (ISP) and any charges assessed by the ISP. You will be provided with the minimum system requirements needed for the use of Benchmark Bank Online and bill payment services.

Benchmark Bank’s liability to you is limited to the extent stated in any other account and/or loan agreements, notices and disclosures that are separately provided to you when you open your account and from time to time regarding your Benchmark Bank accounts and/or this agreement. Applicable provisions of the agreement explain the extent of Benchmark Bank’s liability to you that has not already been separately disclosed to you by any of these agreements, notices or disclosures.

Neither Benchmark Bank, nor any of its directors, employees, or agents make any representations or warranties of any kind regarding the performance or quality of Benchmark Bank Online banking services or the results that may be obtained from using Benchmark Bank Online banking services. Benchmark Bank specifically disclaims any express or implied warranties, including, without limitation, warranties of fitness for a particular purpose, warranties of merchantability or warranties against infringement.

Except as otherwise provided by applicable law, Benchmark Bank, nor its directors, employees or agents shall be liable for any damages or losses, including, without limitation, direct, indirect, consequential, special incidental or punitive damages, resulting from or caused by the use, or attempted use, of Benchmark Bank Online service, or its content, including, without limitation, losses related to your use, or your inability to use, Benchmark Bank Online banking services. Any errors, omissions or defects in any content, interruptions or delays in transmission to Benchmark Bank Online banking service, or computer viruses received by you as a result of your use of Benchmark Bank Online banking service are not the fault of Benchmark Bank. In any event, any liability of BenchmarkBank, its employees, agents, content providers and licensors shall not exceed those amounts specifically provided for in this agreement.
